11 Frequently Asked Questions When Opening a Law Firm

Do I need a website, and how much do I spend on it?

You need a website, but it doesn’t have to be elaborate. The average cost for a basic website is three to five thousand dollars. Just make sure it’s modern-looking, looks good on mobile, and clearly has a way to contact you.

What kind of office setup do I need? Can I use a virtual office?

Yes, in 2024, and after COVID-19 in 2020, virtual offices are more popular than ever among solo practitioners. They offer flexibility and cost savings while still providing professional meeting spaces.

Should I focus on one or two practice areas when starting out?
Yes, focusing on specific practice areas helps position the firm and makes marketing easier. The days of the generalist are over. Also, consider doing a consumer area of law like Criminal Law, Personal Injury, and Family Law.  

Do I need a business bank account and a trust account?
Proper financial management, including the use of a business operating account and a trust account for client funds, is a top concern for new firms. If you do Personal Injury work, you must have a Trust Account. If you’re not doing PI, then a business bank is fine.  

How much should I save before going solo?
It’s recommended that you save up at least three to six months’ worth of living expenses before opening a new firm. I had about four months’ worth saved up back in 2002.

Is client management software necessary from the start?
No. In the beginning, you will not need expensive management software. However, managing client communications and documents efficiently can save time and reduce errors, making legal software an important consideration.

I personally don’t use anything anymore, but many law firms do. Clio.com, Mycase.com, and Lawyerist.com are some popular ones.

How should I handle marketing—should I hire a marketing agency or do it myself?
Many lawyers wonder whether to outsource marketing or manage it themselves, with recommendations to avoid expensive agencies early on. Do not hire a marketing agency in the beginning because they are costly.  

How do I get referrals from other lawyers?
Your lawyer friends will be among those from whom you get most of your referrals. Other lawyers around town should be at the top of your email newsletter list. Also, at the beginning of your own practice, you can get overflow or appearance work. 

Should I offer discounts to family and friends?
New lawyers often find themselves handling cases for family or friends and need to establish clear guidelines to avoid complications. Give them discounts, but show them how much your actual fees are. 

How do I decide between contingency fees or hourly billing?
When setting up a practice, it is important to understand which fee structure works best for different types of cases (e.g., personal injury vs. business law). Personal Injury work is the only area in which to work on contingency. In fact, in Arizona, you can’t work on criminal or family law cases on contingency.

What should I consider when setting up my intake process?
A solid intake process, including how to ask for retainers or fees upfront, is vital for ensuring smooth client onboarding and cash flow. Intake is extremely important. Best practices are to answer the phone immediately, call people back immediately, and take down all vital information. Do not use chat boxes or AI (Artificial Intelligence) for intake.
